Are We Really Celebrating International day of Disabled People?

An interaction program on the status of implementation of existing government policy and programs on disability in the context of United Nations Convention on the Rights of Persons with Disabilities (UNCRPD) was held in the capital on second December 2011 in a hall of the World Trade Center, Nepal. With the initiation of Main Organizing Committee and Nepal Disabled HumanRights center (DHRC), the event was fruitfully concluded with an overview on the status of implementation of policies and with a panel discussion. In additio n to that the ministry representatives briefed us about their upcoming plans and policing which would prove to be a catalyst for the implementation of UNCRPD in Nepal.

Mr. SudarshanSubedi, the founder president of DHRC-Nepal anchored the program towards a successful discussion event. Mr. MaheshworGhimire, the Secretary of DHRC-Nepal, welcomed everyone with a warm greeting and he provided us the outline of the program. Then Sanjay Bantawa the secretary of National Federation of Disable Nepal started the event with his inquiries. Among his other important questions to the audience as well as the panelists, an important query was whether or not we have really addressed the problems of disabled individuals at a national level. Mr. BuddhiSen from the OHCHR conveyed the message of UN through his speech ending it with a message that the UNCRPD is a basic right of disabled individuals. Mr. Ananda RajPokherel, Secretary of Women Children and Social Welfare Ministry, briefed about the policies the government has implemented since the Nepal government participated in the Convention.TikaDahal the chairperson of Nepal Disabled Women Association candidly told the audience that the government should redefine its policies and definition of disabled people. Dahal’s speech was followed by the KedarNathUpadhya’s speech. The Chairperson of National Human Rights Commission focused on providing access to disabled people. Session one was concluded with a remark from Dan BahadurChaudhary the Minister for Women Children and Social Welfare. He delivered his assurance through a very strong voice. He expressed his views of providing service to disabled people along with that he assured that he would prefer to allocate more budget for better recognition of the rights of disabled individuals.

After a short tea break Mr. Dip Magar from the OHCHR-Nepal briefed the audience about the implementation of UNCRPD in a national context. He emphasized on how we can incorporate the convention into domestic law. Subsequently, representatives from Ministry of Women, Children and Social Welfare, Ministry of Education, Ministry of Industry, National Planning Commission, Ministry of land reform and management and Ministry of General Administration updated us about the new reforms and existing policies which uplift the status of disabled people in Nepal.

In the final hour of the program the general public raised issues and question to the panelists. The general public believed that decentralization of power would help in the proper implementation of policies across Nepal. Some even expressed sadness to the fact that free equipment (assistive devices) provided by the government were in reality being sold. They general public requested the representatives to not let this discussion go to vain. The discussion helped the representative to see perspective of public opinion on the policies.

The program successfully ended with a thank you note from the President of DHRC-Nepal, MrJagdish Prasad Adhikary followed by a lunch.

Disable Human Right Center Nepal(DHRC-Nepal) organized 2 days “training DPO communication based and media training at Dadeldhura which is supported by UKAID/DFID and DDP with the coordination of DWSC/Dadeldhura.

The programme was organized to know the situation of physically challenge people,their problems and aspect from central level for the improvement of physically challenges people.

In that programme different leders of district who are working for the welfare of physically challenges people.person were participate. They told about the local problems of physically challenges people and VDC and District level for their welfare.

In the discussion of problems participates explain that in transportation government launch to give 50% discount in transportation but local transportation institution donot give that facility.In the context of special class some where there are more persons than the listed number of people and some where that class are continuing with few members. In that programme participate told that there are also problems in Disable Identity card .Government use to give monthly Rs.300 to those person who got ‘B’ grade disable ID card which is distribute to few number of peoples only.So, other people were lacking from that facility .In the cotext of ID card persons who got ‘D’and ‘E’ grade,they use to tear card by thinking that they donot get allowance which is createddue to lack of ID awareness.

And in life insurance also there is discrimination to physically challenges people participate explain.In this context participate Kalawoti Raaut told that when she went to LIC company to get insurance there’s related member replied that “she cannot success to be agent but if you want then you must not clear that you are disable.” “This is happen because company is doubt that they cannot success to pay.This rule is mend from central level which must be replaced” said press advisor Sangita bhandari

Like this, to minimize poor condition of disable person in local level worker of NNSW kanchanpur Dammari bhatt thqat her institution take information whether disable person get ID or not and also that they use to give advise as well as they provide scholarship to 7 student . And chairperson of DWSP shubhas shaut explain that his organzation take cencus of disable persons in district that ther where 102 disable .Also that they help disable persons to get disable ID card.

According to plane of programme,the media training was also given to participate.In that traning participate where trained, how to write news, it’s structure,and point that must to remain while writing news.

Interaction on "Access in education of disabled people & Verdict of Supreme Court"

Kathmandu 19 September. Although government has said to provide scholarship for 85 thousand disabled students in running year many stakeholders said that the facility given by government is insufficient for such student.

In the interaction program "Access in education of disabled people & Verdict of Supreme Court" organized by Nepal Disabled Human Rights Centre and Education Journalist Group under Secretary Jaya Lamsal of education department told without taking any fee scholarship will be given to disabled students.

For that under school area development program 16 crore amounts has been allotted.

According to him by making category of disabled people in 1^st category for severe disabled (not able to walk) student government provides hostel facilities.

According to education department for 2^nd category yearly 5000, for 3^rd category yearly 3000 and for disabled yearly 500 scholarships is provided.

In that program participated stakeholders told although there is written to give free education for disabled students in policy and rules many educational organizations are taking fee & there is not disabled access environment.

Right Activist or Advocate Shudarson Subedi told free education should be given by all educational sector according to the Verdict done by Supreme Court on 2060 Kartik 27 .

He complains after the Certificate level phase out from University disabled students are forced to pay fee in Private and Government Colleges.

Low vision student Ichhaya K.C. studying master shared paying fee and due to the lack of good environment of classroom we have to face problems while studying.

Secretary of Higher level Education Ramesh Silwal said he was unknown about the Verdict of Supreme Court before and he gave words that in coming days he will give priority to disabled students in scholarship Quota.

For that government should distribute ID card by giving clear description of disability.

PABSON General Secretary Bijaya Simbahamfe shared that they are providing 2% scholarship to disabled student but he committed to increase it in coming days.

Maya Devi Sharma from Human Rights Commission gave information that many complains in commission comes about the lack of disabled access infrastructure and government has also paid attention in the complain related to education.

President of Nepal Disabled Human Rights Centre Jagadish Prasad Adhikari said if there will be right definition of Supreme Court Verdict than disabled student should get free education in government/private schools, coaching centre.

Prakash Silwal President of Education Journalist group said he will make time to time discussion & research in this subject.

“नेपाल अपाङ्ग मानव अधिकार केन्द्र” अपाङ्गता भएका व्यक्तिहरुको मानव अधिकारको सवालमा वकालत गर्ने राष्ट्रिय स्तरको गैर सरकारी संस्था हो ।

नेपालमा करिव २४ लाखको संख्यामा अपाङ्गता भएका व्यक्तिहरु रहेका छन् । जस मध्ये ६ लाख भन्दा बढिको हाराहारीमा बौद्धिक अपाङ्गता तथा अति अशक्त अपाङ्गता भएका व्यक्तिहरु रहेका छन ।

नेपालमा अति अशक्त र बौद्धिक अपाङ्गता भएका व्यक्तिहरुको अवस्था दिन प्रतिदिन दयनिय भएको छ । एकातिर राज्यले व्यवस्था गरेको ऐन कानून पनि यो वर्गका लागि प्रभावकारी रुपमा कार्यन्वयन हुन सकेका छैनन् भने अर्को तिर राज्यबाट उपलब्ध सेवा सुविधा प्राप्त गर्नबाट यो वर्ग बञ्चित रहेको छ । जुन घर परिवारमा अशक्त र बौद्धिक अपाङ्गता भएका व्यक्तिहरु छन ती घर परिवारका सदस्य सधै यिनीहरुको सेवा र स्याहारमा लाग्नु पर्ने हुँदा सधै बोझको रुपमा हेरिन्छ ।

कोहि पनि आफन्तजन नभएका यि प्रकृतिका अपाङ्गता भएका व्यक्तिहरुको अवस्था झनै दयनिय रहेको छ । यस सवाललाई लिएर केन्द्रले सरोकारवालाहरुसंग जानकारी माग गर्दै विभिन्न समयमा पत्राचार गर्र्यो तर त्यस पत्रको कुनै पनि वास्ता गरिएन तसर्थ बाध्य भएर अधिवक्ता सुदर्शन सुवेदी र अति अशक्त अपाङ्गताको तर्फबाट दिपेन्द्र शाक्यले नेपाल अपाङ्ग मानव अधिकार केन्द्रका तर्फबाट आज सर्वोच्च अदालतमा रिट निवेदन दायर भयो ।

उक्त रिट निवेदनमा अपाङ्गता मैत्री भौतिक वातावरण हुनु पर्ने, अति अशक्त र बौद्धिक अपाङ्गता भएका व्यक्तिहरुको हकमा बेरोजगार भत्ता, सहित सहयोगीको व्यवस्था गर्नु पर्ने, शिक्षा स्वास्थ्यको ग्यारेन्टी गरिनु पर्ने, असहाय र बेसहाराहरुको लागि सामुदायिक अपाङ्ग घर निर्माण गर्नु पर्ने, परम्परागत अपाङ्ग संरक्षण तथा कल्याण ऐन २००३९ लाई पुर्नलेखन गर्नु पर्ने जस्ता माग राखिएको छ ।

Nepal Disabled Human Rights Centre is a National level NGO; advocates on the issues of Human Rights of Persons with Disabilities.

It is assume that 2.4 million Persons with disabilities are situated in Nepal. Among them more than 6 hundred thousand people are people with Intellectual disability and severe disability.

The living condition of people with severe and Intellectual disability is getting worse day by day. The existing policy has not been properly implemented for people with severely and intellectually disabled. The situation leading them to the bottom pile of socio economic status and not able to utilize the services offered by the government. In a family where there is person with severe and Intellectual disability the member of the family have to help them regularly so they always take them as a burden.

We can't imagine how worse the situation of severe Person with disability who doesn't have any relatives. On this issue DHRC-Nepal has send letters to stakeholders time to time for seeking information but there was not any response of that letter so from Nepal Disabled Human Rights Centre Advocate Shudarson Subedi and from the side of severe disability Dipendra Shakya has registered write petition today on Supreme Court.

In this write application we are demanding for disability access physical Infrastructure, on the condition of severe and Intellectual disability unemployment allowance and caretaker should be given, there should be guarantee of education, health, Community disability house should be made for helpless people and re-writing of disabled protection & welfare act 2039.

Government must ensure the rights of PwDs by signing the Convention
A 'face to face program on' United Nations' convention on the rights of person with disability and optional protocol (UNCRPD-2006) has been organized here in kathmandu on Saturday, 2nd December. The program was coordinated by Nepal disabled Human Right Center (DHRC-Nepal) in order to create pressure over Nepal government to sign the convention. However the convention on the rights of person with disability and optional protocol was passed in the 61st general Assembly of united Nation"- informed Shudarson Subedi chairperson of the program and the president of DHRC.
Addressing the program the chief of United Nation Human Right Commission to Nepal, Richard Benect said that government must ensure the rights of person with disabilities by signing the convention. He informed the participants “it is the first time in the history of United Nation to be signed the convention be 118 Nations during the shortest period. He further told that seven countries have ratified it.
Member of Human Rights and justice committee in the interim parliament Jagannath Khatiwada centered his speech to construct the new constitution which could include the Human Rights of every people.
The leader of Nepali Congress Lokesh Dhakal appealed the government to be practical in every aspect of signing the convention. He focused that only signing the document is not the vital job. "We have a long way to walk after it."- He added. The representative of Nepal government Kedar Paudel informed to all the participants that the government has already begun the process to sign and ratify the UN convention. The Maoist leder Keshab Nepal, human rights activists Charan Prasai, Bhojraj Shrestha, Shasikali Singh have also delivered their speech in the program. Maheshwar Ghimire, the general secretary has conducted the program and Jagadish Prashad Adhikari, the treasures of DHRC given the welcome speech to the participants.

16th INTERNATIONAL DAY OF DISABLED PEOPLE: CELEBRATION IN NEPAL
Having performed different activities throughout the country 16th International day of persons with disabilities has been celebrated in Nepal. Most of the programs held in the nations demanded the government to sign the "Convention on the Rights of Persons with Disabilities and Optional Protocol (UN CRPD-2006)." The convention was passed in the 61st general assembly of United Nation in 2006. They also asked the government to ensure them decent work for living and express commitment to guarantee their rights.
On the occasion of International day of Disabled people a Face to Face program was organized on 'Convention on the Rights of Persons with disabilities and Optional Protocol (UN CRPD-2006) by Nepal Disabled Human Rights Center (DHRC-Nepal) in Kathmandu on Sunday of 2nd December. Speaking in the program Richard Bennett, the chief of United Nation Human Rights Commission to Nepal appealed to the government to sign the UN-Convention and be one of the parts of the movement of person with disabilities.

A rally was organized in Kathmandu by National Celebration Committee for International Day of Disabled people on Monday, 3rd December. Addressing the program after rally, Subash Nembwang, the speaker in the Interim Parliament said that the Parliament should open the path of rights of persons with disabilities by signing the UN-Convention.
Many programs were organized on the issue of Disabilities in various parts of the country on this Day. A unique function was arranged in the Hospital and Rehabilitation Center for Children in Kavre, a local district 25km far from Kathmandu. The function was peculiar in a sense that the chief guest and all the participants were Persons with Disabilities who expressed their sorrow and feelings and demanded their Rights through Singing and Dancing. Tanka Kumari Lamichhane a disabled woman from Nawalparasi the western part of Nepal and the Chief Guest of the program challenged the government that disabled people also can bear the responsibilities of the nation if they are provided with the equal opportunity.

Nepal is a small landlocked country with a population of around 23 million. The World Health Organisation (WHO) estimates that around 10% of the population of developing countries has some form of disability. However, after ten years of armed conflict, the reality is that the figure for Nepal will be higher than this estimate. People with Disabilities (PWDs) are the most marginalized and disadvantaged citizens of Nepali Society. Despite the active involvement of PWDs in the momentous political changes that took place in 2006 and the resulting promise of democracy, political leaders and policymakers are still ignoring the issues of PWDs. Consequently, they are still struggling to achieve a dignified and respectable life.

Nepal Disabled Human Rights Centre (DHRC-Nepal) has been working for six years to achieve rights and inclusion for PWDs in Nepal. Recently, DHRC arranged a one-day advocacy workshop in Kathmandu on the "Role of the Stakeholder for Disability Rights and Inclusion". The main objective of the program was to improve awareness and create pressure on the different stakeholders for disability rights and inclusion. A total of 93 participants attended from political parties, civil society leaders, NGOs, Human Rights workers, government officials, Disabled Peoples Organisation leaders and the media.
A half day discussion was held to establish the main areas where PWDs face discrimination and to gather commitment from the different stakeholders. At the end of the workshop all the participants committed themselves to include PWD issues in their programs and institutions.

DHRC has also arranged an advocacy meeting with the Vice Chairperson of the National Planning Commission (NPC) Dr. Jagadish Chandra Pokhrel, NPC Member Indira Shrestha and the Minister of Women, Children and Social Welfare, Urmila Aryal. At this meeting, DHRC put forward their agenda to create a development plan that was fully inclusive and a proposal to give a public holiday for disabled employees on International Disability Day and to create a disability friendly environment in all government and public buildings.
As a result, the Government announced a public holiday for disabled employees on International Disability day every year and the National Planning Commission will start to include disability issues in the interim plan. The House of members of Parliament is to be provided with a ramp to make it more accessible to PWDs and it was announced that the Kathmandu District Administration Office (DAO) at Tanahun now had a new ramp.
